The Court of Cassation confirms the legality of wiretaps conducted on former Avellino mayor Festa. In a ruling that sheds light on the intricate dynamics of the "Dolce Vita" investigation, the Supreme Court has definitively upheld the validity of the wiretaps conducted by the Avellino Prosecutor's Office against Gianluca Festa.
The defense of the former mayor had raised serious doubts about the legitimacy of the installation of bugs, Trojans and cameras in the municipal offices and in his personal vehicle, contesting the violation of privacy and the excessiveness of the investigative measures.
However, the "ermines" considered the reasons given by the Prosecutor's Office to be well-founded, as they had underlined the seriousness of the alleged crimes and the need to acquire concrete evidence to support the accusation.
In the reasons for the sentence, the Court of Cassation examined in depth the individual contested episodes, rigorously analyzing the wiretaps and other evidence collected by the investigators.
In particular, the Court confirmed the evidentiary relevance of the conversations between Party and the architect Fabio Guerriero, considering them indicative of a system of corruption involving several local entrepreneurs.
It is important to underline that, while confirming the legitimacy of the wiretaps, the Court of Cassation annulled some of the charges initially brought against Festa, such as that of misdirection and undue inducement.
This means that, although the evidence collected was deemed valid, it was not sufficient to prove the former mayor's guilt in relation to these specific crimes.
