The Caserta biodigester will not be built following the Regional Administrative Court's ruling: "It is not part of the Area's plan." The Regional Administrative Court (TAR) declares the appeal by neighboring municipalities "inadmissible" following the revocation of funding by the Region.
The Regional Administrative Court of Campania has issued a definitive ruling regarding the biodigester planned for Caserta, declaring the appeal of the municipalities of San Nicola la Strada, Casagiove, Recale, and Capodrise, as well as Legambiente, Speranza for Caserta and former councilors Norma Naim and Francesco Apperti, “inadmissible” due to lack of interest.
Judge Vincenzo Salamone stressed that the construction of the plant in Ponteselice is no longer feasible, since the Region has revoked the funding and the plant is not included in the Integrated Waste Management Area Plan.
Attorney Paolo Centore, representing the appellants, expressed satisfaction with the ruling. During the trial, Centore managed to obtain three orders from the TAR that required the Municipality to Caserta to produce the documents.
Due to the failure of the Municipality to file the documents, the Ministry of the Environment and Energy Security was appointed as verifier. The TAR ruling is based on the report of this ministry.
