Naples. The time for justice is approaching for the relatives of the late and innocent Adrian Olmo.
The young man from Naples, just 28 years old, was hit and killed by a hit-and-run driver while crossing the road on the pedestrian crossing in via Milan, at number 35, in Naples, not far from home, on November 29, 2021, around 21 pm.
At the conclusion of the rapid preliminary investigations, the Public Prosecutor of the City Attorney's Office, Dr. Francesca Falconi, requested that the driver of the car, which later turned out to be a Maserati Levante, which was established only at a later time: it is a question of Alfonso Santaniello, 31 years old, also from Naples.
The defendant will have to answer for the crime of road homicide with the heavy aggravating circumstance of escape. Recognizing the request, with a decree issued on May 6, 2022, the Gup of the Court of Naples, Dr. Ambra Cerabona, has set the preliminary hearing for September 22, 2022, at 9.30 am, of a trial from which the victim's relatives, who have turned to Studio3A-Valore SpA. and who are assisted in criminal matters by the lawyer of the Santa Maria Capua Vetere court Vincenzo Cortellessa, expect a strong response and an appropriate punishment.
Also because the investigation, as a partial consolation for the Olmo family, confirmed that Adrian had no responsibility whatsoever for the tragic accident: his only “fault” was being in the wrong place at the wrong time and running into the “wrong person”.
In fact, the Deputy Prosecutor considered Santaniello, who is accused, to be the only one responsible for the investment “fault consisting of negligence, imprudence, incompetence and violation of the rules of the highway code, in particular of Articles 141, which provides for the obligation to regulate speed in such a way as to avoid any danger to the safety of persons, and of Article 191 which provides for the obligation of drivers to stop when pedestrians pass on pedestrian crossings” to quote the request.
From the findings of the Local police di Napoli, who carried out the surveys, it emerged that the driver “traveled along Via Milano at high speed towards the entrance to the Naples Capodimonte ring road” and hit the pedestrian who was, regularly, “crossing the road at the pedestrian crossing”: a tremendous impact.
“By hitting him with the front right side of the car, he pushed him towards a car, a Toyota Yaris, parked along Via Milano and then threw him 16 meters ahead, making him fall to the ground and causing his death. And then he fled” concludes the magistrate by highlighting the further aggravating circumstance contested to the motorist.
The defendant turned himself in only two days later, on December 1st, appearing at the offices of the local police in Naples with two lawyers and the SUVs which bore on its nose the evident signs of the terrible collision with the pedestrian: the officers were in any case already on its trail.
He justified his very serious conduct by claiming that he was scared and ran away, but this will not avoid his conviction, also because Adrian did not die immediately, he was rescued by some passers-by, including a health worker, and taken in desperate conditions to theCardarelli hospital, where he passed away shortly after.
The autopsy ordered by the PM, and entrusted to the Medical examiner Prof. Pietro Tarsitano, Director of the Forensic Medicine Unit of the Cardarelli and professor at the Federico II University, did nothing but confirm that the young man died following the very serious polytraumatic and haemorrhagic injuries suffered as a result of the accident and perfectly compatible with a raised vehicle.
The expert operations were also attended by Dr. Mauro Perrino as a medical-legal consultant for the injured parties made available by Studio3A-Valore SpA, a company specialized at a national level in compensation for damages and the protection of citizens' rights, to whom Adrian's family, through legal consultant Dr. Vincenzo Carotenuto, have entrusted themselves for assistance.
Hence, at the end of the preliminary investigations, the request for trial for the driver, for whom Adrian's father, mother and sister are asking for a sentence commensurate with the very serious crimes he committed: it will never be known, moreover, whether the driver was driving under the influence of alcohol or drugs, having become untraceable, it was not possible to immediately subject him, as is necessary, to blood tests.
