At the conclusion of the preliminary hearing, which took place on 23 September, the preliminary hearing judge had sent eight defendants to trial, six prison police officers, including the commander, Stephen The Cava, a prison doctor and a nurse, accused of torture and aggravated bodily harm.
While he had ordered the dismissal of charges against six other officers, Alessandro Gugliotta, Carmelo Vazzana, Diego Ielo, Angelo Longo, Stefano Munafò and Antonino Biondo.
Decision motivated by the fact that the latter, according to the preliminary hearing judge, had indeed participated in the beating “but only with a passive presence – the judge wrote in the sentence – and not participating in the violent actions”.
The acquitted officers, the judge also wrote, “they did not, at any time, commit acts of violence against the prisoner Peluso”.
Against the ruling of the preliminary hearing judge, the Prosecutor's Office has filed an appeal, signed by the prosecutor Giovanni Bombardieri, the deputy prosecutor Stefano Musolino and the substitute prosecutor Sara Parezzan, to the Court of Appeal, requesting that the preliminary hearing judge's order be “it should be declared null and void and all the defendants should be sent to trial”.
According to the Prosecutor's Office, in particular, in the judge's sentence “the acquittal formula is missing and it is not clear why the defendants were acquitted”.
