The Court of Appeal of Napoli who had the opportunity to analyze both the merits of the charges and the precautionary requirements, deemed it appropriate to invalidate the order with respect to the position of Solimeno Raffaele, alias a capitana.
The request of his defense attorney, Gennaro De Gennaro, was accepted. The order was issued due to "lack of serious evidence of guilt" for both the crime of participation in the Camorra association and the association dedicated to drug trafficking.
The only one of the 13 defendants subjected to the most afflictive measure, namely prison, to obtain the cancellation of all charges, with the consequent return to freedom.

According to the prosecution, the suspect is said to have managed the Boscoreale drug dealing area in the “piano Napoli” district of Via Settetermini, as well as being the stable supplier of large quantities of drugs for the group and the trusted man of the clan leader Giuseppe Pesacane with specific authority to commit robberies and violent acts.
The charges against him are based on a series of wiretaps with the Pesacane clan leader in which reference is made to the operations that were to be organised.
A few weeks ago Solimeno Raffaele was arrested and transferred to the Secondigliano prison with 28 other people who allegedly carried out criminal activities in Boscotrecase and Boscoreale, places where the clan Gallo – Limelli – Vangone and Pesacane. The nightmare for the suspect is over.
