The evidentiary hearing took place today before Dr. Alessandra Grammatica, Judge for Preliminary Investigations of the Court of Santa Maria Capua Vetere (after the psychiatric assessment) in the trial against Francis Plumitallo.
The 30 year old young man, of capodrise guilty of strangling his own mother Patricia Lombardi Vella, 55 years old called Rosa. The expert appointed by the Judge, the psychiatrist Dr., was heard first in cross-examination. Raffaele Sperandeo , then the defense psychiatrist consultant Dr. John D'Angelo and together they concluded by saying that the 30-year-old was completely lacking in mental capacity at the time of the crime because he suffered from total mental infirmity.
However, while Dr. Sperandeo considered him capable of consciously participating in the trial, Dr. D'Angelo concluded differently, namely that he was incapable. The psychiatric assessment was requested – during the hearing to validate the arrest – by Francesco Plumitallo's lawyers, Raffaele and Gaetano Crisileo.
This was followed by a similar request for an evidentiary incident by the Public Prosecutor Dr. Giacomo Urbano. The Judge (who had ordered the young man to be imprisoned and kept under surveillance, fearing acts of self-harm) now finds himself faced with a choice: to leave Francesco in prison or to transfer him to an appropriate facility where he can be treated by psychiatrists to prevent him from repeating an insane act and taking his own life (for example, a transfer to a REIMS could be considered).
The murder took place on November 14th in Capodrise
For the record, the bloody incident occurred early in the morning on Tuesday 14th November last in an apartment in capodrise in the palace of the Vella family in St. Mary of the Angels StreetAccording to the version given by Francesco, he was having breakfast with his mother.
Then he approached her, took her as if to hug her and then strangled her from behind and when they both fell to the ground he caressed her. He himself then called the police and his uncle priest Don Gianni Vella. Francesco Plumitallo then confessed what had happened to the Public Prosecutor Dr. Giacomo Urbano and Dr. Alessandra Grammatica.
He described the scene, of which he remembered almost nothing, as a moment of rage in which he had not taken the medicine prescribed by the doctor. Mental Health Center of Marcianise and had completely lost control.
Meanwhile, an autopsy was performed on Rosa's body by the coroner Dr. Homer Pinto performed at the Sant'Anna and San Sebastiano University Hospital in Caserta but the results are not yet known. We are now waiting for the Judge's decision on the continuation of the trial.
