The Court of Cassation has referred to the Court of Appeal of Rome the case of nine defendants, who had chosen the abbreviated procedure, involved in the assault on the CGIL headquarters that took place on 9 October 2021 during a no Green Pass demonstration organized by Forza Nuova, led by leader Giuliano Castellino.
The sentences issued by the Court of Appeal of Rome were annulled with referral by the judges of the first criminal section of the Court of Cassation, who accepted the in-depth legal reasons illustrated by the cassationists Dario Vannetiello, Carlo Taormina, Nicola Trisciuoglio and Luca Ripoli.
Among the defendants whose positions have been adjourned for a new appeal are Fabio Corradetti, the son of Giuliano Castellino's partner, the coordinator of Forza Nuova in Palermo, Massimiliano Ursino, Claudio Toia, leader of the Juventus ultras movement "Antichi Valori", and Mirko Passerini.
The magistrates explained that the postponement was determined by “lack of motivation” in the previous sentences regarding the reconstruction of the facts in terms of disturbance of public order, which is a key element of the contested crime.
The prison doors should have opened immediately if it had been a conviction, but the arguments offered by the defense team aimed at demonstrating both the absence of damage to public order and the many motivational deficiencies of the conviction have made inroads into the Supreme Court.
What is being discussed is one of the strands of the larger investigation that reached the many accused, including Giulio Castellino, Roberto Fiore, Aronica Luigi and many others.
