Naples – With the formula "the fact does not exist", the single judge Eliana Franco acquitted Pierluigi and Luca D'Angelo, managers of the Hippodrome of Agnano, from the charge of manslaughter for the death of 62-year-old Moroccan Mohamed Boulhaziz, crushed by a cypress tree that collapsed inside the structure on December 22, 2019.
The defense of the defendants, represented by the lawyer Marco Campora, demonstrated that all safety regulations had been respected and the collapse was caused by "exceptional weather conditions" (as certified by technical reports). No negligence in the maintenance of the green area
“The sentence recognizes the absolute non-involvement of my assistants in this tragic event,” declared Campora, expressing satisfaction with the outcome of the trial.
The accident dates back to almost 6 years ago, when Boulhaziz lost his life during an exceptional windstorm. In addition to the D'Angelos, the other defendants, defended by lawyers Mariavittoria Russo, Marcello Marasco and Luca Raviele, were also fully acquitted.
The sentence is not appealable as it was issued in the first instance with a full acquittal formula. The victim's family may eventually start a civil action for damages.
