«A new legal victory for Nursing Up: a new extraordinary result, after the recent triumph at the Supreme Court which, just a few days later, leaves an indelible mark on the battle that the union has been waging for years for the valorization of the nursing profession.

Not only street battles, not only strikes, not only flash mobs have characterized the past year, in the midst of the pandemic emergency, alongside the daily challenges in hospital wards, in the daily fight against the "enemy". The battles of Nursing Up have been fought for some time, thanks to our pools of lawyers, even in courtrooms".

«This time, Antonio De Palma, National President of Nursing Up, tells us, the “theater” of what was announced as yet another arduous challenge to overcome, was Campania, a territory where the precariousness of health workers has been the order of the day for too long, within a system that has been plagued over the years by cuts and reckless management.

For too long in Campania, as in other regions, precarious employment has been a plague to be eradicated: for too long, health workers have paid the price for the shortcomings of a system that does not value them, compared to years of work built on knowledge, experience and human qualities, at the service of patients.

For years, the strenuous fight for the stabilization of precarious workers has been one of the primary objectives of our union, continues De Palma. And now we can say that we have made it with this "historic" ruling by the TAR of Campania.

We have legally supported the requests of numerous precarious workers, against the ASL of Caserta: we are talking about cooperative workers, who for over ten years have seen themselves used in the most disparate ways. However, we hit rock bottom when the local health authority, faced with the law that highlighted the need to stabilize those who were employed by the ASL, caged precisely in non-permanent contracts, unduly excluded the cooperative health workers from this privilege, denying them the opportunity offered to other colleagues. Considering them unexpectedly "second-class professionals".

An unacceptable difference in treatment, which undermines human dignity at its foundation, when it denies the right to job stability.

We did it! The Campania Regional Administrative Court ruling has proven our lawyers' thesis right. Pronouncing a sacrosanct principle: that is, that there cannot be differences in treatment between precarious nurses directly hired by the ASL and those who have indirect employment relationships with them, because they are part of the cooperative system. If there is a law that requires healthcare workers to be stabilized through a competitive process reserved for them, this opportunity must be offered to everyone, in the same way.

At a key moment for the future of Italians' health, at a time when the quality of healthcare professionals in the field can and must make the difference to emerge from the pandemic nightmare that has afflicted us for a year now, the valorization of healthcare professions, starting with nursing, becomes a primary objective to offer patients, citizens, the solidity of a system where nurses remain the backbone", concludes De Palma.
