Il Court di Napoli Nord has ordered a further investigation into a death compensation case that presents several inconsistencies.
The two sisters involved in the case, residents of Naples, relied on an expert who pretended to be a lawyer. According to their lawyer, Francesco Angelino, the professional convinced them to sign a compensation for the damage suffered that was far lower than that offered by the insurance company: 55.000 euros compared to an offer of 362.000 euros.
Furthermore, the two women were unaware of the insurance company's real proposal.
The complaint to the Public Prosecutor's Office dates back to June 2022. The sisters, suspicious, asked the lawyer Angelino to do further investigations, from which it emerged that the expert was not actually a lawyer.
The lawyer's opposition to the request for archiving formulated by the investigators was accepted by the preliminary investigations judge of Napoli North Daniele Grunieri.
The judge ordered the acquisition of the insurance practice relating to the road accident, noting an “obvious contradiction” between the initial offer and the amount accepted.
In the document with which he requested and obtained the additional investigation, the lawyer Angelino hypothesizes the crimes of "fraud with aggravating circumstances of impaired defense and/or the deception of incapable persons".
The case is emblematic of the possible pitfalls that lie behind the signature of a compensation. It is therefore essential to rely on a trusted lawyer to protect your rights and obtain the right compensation.
