The demolition took place in execution of an order issued by the Court of Torre Annunziata, Pompeii branch, and is part of a broader project to eliminate building abuses present in the area, which represents one of the priorities of the Public Prosecutor's Office.
The building consisted of a ground floor, first floor and second floor, with ramped stairs except for the first floor. The area affected by the illegal construction is subject to various restrictions:
Constraint of significant public interest pursuant to Law 1497/39;
“Red” zone at volcanic risk, as per LR n. 21 of 10/12/2013;
Archaeological constraint;
Provincial buffer zone.
Furthermore, the municipal territory of Pompeii is classified as a category I seismic zone (S=9 – C=0,07), according to the resolution of the Campania regional council n. 5447 of 07/11/2002.
The implementation of demolitions of illegal buildings ordered by the Judicial Authority represents an irreplaceable instrument for the protection of the territory, both in repressive terms for the restoration of the violated environment, and preventive for the dissuasive effectiveness against illegal building. In this specific case, a sentence referring to a 1998 sentence was carried out.
Thanks also to the intense awareness campaign promoted by this Office, the demolition was carried out by self-demolition by the owner of the illegal building, without any costs advanced by the Municipality concerned or by the Cassa Depositi e Prestiti.
