Annunziata Tower – The investigating judge of the Court of Torre Annunziata, Dr. Cozzitorto, he arranged the release from prison and full freedom for Carmine Falzarano, 44 years old from Airola, well-known criminal, accused of two aggravated thefts for a total of 11 thousand euros in Vico Equense.
Article Key Points
The decision came after the defense arguments put forward by the lawyers were accepted Victor Fucci and Joseph Victor Fucci.
The judicial affair
Falzarano had been involved in an investigation which saw him accused of two aggravated thefts, completed in competition with Alessandro D'Ambrosio, for whom, instead, prison custody was confirmed. His position was eased following the preventive interrogation introduced by Nordio reform, which allowed the judge to re-evaluate the need for the precautionary measure requested by the Public Prosecutor.
The elements of the accusation
The investigation was supported by numerous findings:
-
Video surveillance footage of the commercial activity affected by the thefts, in which the two suspects were clearly visible.
-
Footage from municipal cameras of Vico Equense, who immortalized Falzarano's car, with a clearly visible license plate, near the place and at the time of the thefts.
-
Telephone records who connected the suspect's cell phone to cells in the area.
-
Facial recognition of the two subjects.
-
Identification of the clothes worn by Falzarano, which were the same ones used in another theft that had previously occurred in Vico Equense, for which the man had already been arrested and subsequently released from prison.
Despite the solidity of the investigative elements, the court deemed that the conditions for preventive detention did not exist, granting Falzarano his freedom.

It's incredible how a judge who has all the clear evidence decides to free a person with so many precedents. I don't know if it's right or wrong, but it makes me think about justice in Italy.
