The Campania Regional Administrative Court has rejected the request for precautionary protection presented by the Mare Libero association against the restricted number of people on the public beaches of “Donn'Anna” and “Delle Monache” in Napoli.According to the judges of the seventh section of the TAR Campania "the reasons underlying the provision of a quota following the review ordered by the TAR are adequately represented and evaluated in the supplementary act to the resolution of 9 August 2024".
And again: "Emerging from the same the considered evaluation of the opposing interests involved, given that the free use of the beach cannot be separated from the protection of the interests of public safety and security, considering that the elements of the extremely serious and urgent damage feared by the appellant association do not appear to exist, since the most significant part of the bathing season has now passed". With the same act, the hearing for the collegial decision was set for September 25. "The bathing season continues as already planned", underlines the Municipality of Naples in a note.
The limitations on the number of accesses permitted on the free beaches of Posillipo are provided for by the integration of the collaboration agreements signed by the Municipality of Naples and the Port System Authority of the Central Tyrrhenian Sea. The integration was made necessary following the order of the seventh section of the Campania Regional Administrative Court which had imposed a review of the agreements signed last May.
