Maximum sentence for the Bianchi brothers and two 24-year sentences for Mario Pincarelli and Francesco Belleggia. These are the heavy requests for conviction by the Velletri Prosecutor's Office for the gang, for 'the Artena four', who beat up the 6-year-old on the night of September 2020, 21 Willy Monteiro Duarte, in front of a club in Colleferro, a town in the province of Rome.
In seven hours of prosecution, before the judges of the Assize Court of Frosinone, the deputy prosecutors Francesco Brando and Giovanni Taglialatela reconstructed the phases of that dramatic night in which the body of a young boy was "used like a punching bag" during "a crude and savage attack carried out by four individuals".
A voluntary action, a murderous fury against a young man who found himself “in the wrong place at the wrong time”: a fight broke out outside a pub, the “Due di picche” then the arrival of the four who, as told by a witness, got out of a car and threw themselves at anyone who happened to be in range. According to the prosecution representatives, anyone that night, in that square, could have ended up like Willy.
“The action started with Marco and Gabriele Bianchi but then it merged with the action of Belleggia and Pincarelli and became a unitary action – the prosecutors explained -. What happened to Duarte could have happened to anyone else who had found themselves facing” the pack.
A central role in the indictment was played by the modus operandi of the four and in particular their knowledge of MMA, the martial art in which the Whites are experts, which was used as a weapon to "annihilate the opponent" and to "do it without considering the consequences of the blows". "Technical blows given to hurt, very violent to cause very serious consequences.
From the scientific tests it emerged that on Belleggia's shoe there are biological traces of Samuele Cenciarelli who had tried to defend Willy. Cenciarelli could also have died that evening". The prosecutors in the courtroom also dismantled the reconstructions provided during the trial by two witnesses, Roussi Faiza and Aldo Proietti, asking for the transmission of the documents to the prosecutor's office for false testimony.
The beating lasted about 50, interminable, seconds during which the victim was hit by repeated blows: "50 seconds of incredible suffering". The defendants attacked the young man's body when he was on the ground and helpless: an action that falls entirely within voluntary homicide. According to the prosecution, the four that night "wanted to kill" and "Willy in fact did not defend himself, he was taken by surprise in a matter in which he had nothing to do".
“We believe this was a deliberate, voluntary and not unintentional homicide,” prosecutors said, arguing that all four took part in the beating. The wiretaps in the investigation documents provided confirmation of that tragic night. Pincarelli, in a recorded conversation, said in dialect: “I hit him when he was on the ground” (I hit him when he was on the ground, ed.)”.
Words so heavy that the father raises his voice and invites him to be quiet: “zitto n'atra vota (shut up again)”. Willy's mother was also present in the courtroom and could not hold back her tears. “I hope that the long detention will bring the defendants the opportunity for re-education, for real repentance. Today, with the request for such high sentences by the Prosecutor's Office, we cannot speak of a result achieved.
Not only because we have to wait for the sentence, but also because as representatives of civil society we cannot help but suffer for what happened", said the lawyer Domenico Marzi, the lawyer of the Monteiro family. In the trial, the municipality of Colleferro also appears as injured parties, represented in court by the lawyer Maurizio Frasacco.
