What did their loved one suddenly die of? Why was he or she discharged from the hospital? Did he or she receive all the care he or she needed?
Could he have been saved? In response to the complaint filed by the brothers, assisted by Studio3A-Valore SpA, the Public Prosecutor's Office of Santa Maria Capua Vetere, in the province of Caserta, through the Public Prosecutor Dr. Valentina Santoro, has opened criminal proceedings for the hypothesis of the crime of manslaughter in the healthcare sector, currently against unknown persons, on the death of MP, 56 years old, from Alife (CE), which occurred on Thursday 26 January 2023 at the Sessa Aurunca hospital.
The Deputy Prosecutor has also seized all medical records, including those of the social care facility where the victim was permanently hospitalized, and also the body in preparation for the autopsy, which will be scheduled for next week and will be carried out at the Institute of Forensic Medicine of the Civil Hospital of Caserta.
MP had been a guest at the Villa della Rocca Residence-Housing Home in Rocca d'Evandro since 1996, suffering from schizophrenia and hepatitis C, a condition that was, however, treated successfully over the years. In fact, physically, the fifty-six-year-old was well and even on the occasion of the last visit, on January 12, 2023, his brothers had found him in excellent health and had not received any different information until the evening of Wednesday, January 25, when the doctor who works in the care facility informed them that they would take their brother to the hospital and, subsequently, shortly before 26:XNUMX a.m. on January XNUMX, that he had (finally) been admitted to the hospital and had been given a catheter.
In fact, as they later found out, their loved one had already shown a strange abdominal swelling on Tuesday 24 January, so much so that Villa della Rocca had alerted 118 and the patient had been transported by ambulance to the emergency room in Sessa Aurunca, from where, however, after having prescribed a therapy that was at the time unknown to his relatives, they had sent him back to his home.
But the situation had not improved at all, so much so that the next day, January 25, at the height of a day in which the abdominal discomfort had persisted without interruption, the healthcare facility called 118 again and the patient was admitted to the Sessa Aurunca civil hospital again, at around 20:XNUMX p.m. Even in this case, however, the health workers intended to discharge him, but it was the firm opposition of the operator from Villa della Rocca who had accompanied him that convinced the hospital doctors to admit him for the appropriate tests and further investigations.
One of the victim's brothers, having received no further news, left home at 9 am on January 26 to reach the hospital, but he did not have time to arrive before the doctor from Villa della Rocca informed him by telephone of his brother's death due to an unspecified cardiac arrest. The relative was in shock and even more so after seeing his brother's body in the mortuary, which had a completely abnormal abdominal swelling.
Hence the decision to shed full light on the facts. The relatives of the victim, through legal advisor Dr. Simone Sangiovanni, turned to Studio3A-Valore SpA, a company specialized at a national level in compensation for damages and the protection of citizens' rights, and on the afternoon of the same January 26, a complaint was filed at the Carabinieri barracks in Sessa Aurunca, in which the judicial authority is asked to clarify the matter, ascertaining the real causes of death and, above all, any responsibilities of the health workers who treated the fifty-six-year-old in both the facilities involved, the Sessa hospital and Villa della Rocca. Requests, as mentioned, deemed worthy of acceptance by the Prosecutor's Office, which has opened a file with the consequent, initial provisions.
