Cervinara. The hearings of the appeal trial for the murder of Nicola Zeppetelli, the forty-year-old from Cervinara killed on February 19, 2022, continue.
Today, at the Court of Assizes of Naples, the lawyers of the civil parties reiterated the charges against Alessio Maglione and Giuseppe Moscatiello, both already convicted in the first instance.
Lawyer Vittorio Fucci, who represents the largest number of civil parties, including the victim's family, strongly supported the confirmation of the sentences. His arguments were also shared by lawyers Rolando Iorio and Marianna Febbraio, who defend the other civil parties.
In contrast, lawyer Luigi Petrillo, Moscatiello's defender, tried to downplay the severity of the charges against his client.
The final hearing of the trial is set for September 26, 2024, when Maglione's defense attorneys will present their arguments.
The requests for conviction
The civil parties, represented by various lawyers, have requested confirmation of the sentences handed down in the first instance to Maglione and Moscatiello, namely life imprisonment for Maglione and 18 years of imprisonment for Moscatiello.
The facts and the motive
Nicola Zeppetelli was shot dead on the evening of February 19, 2022, near his club in Cervinara. The alleged murderers, Alessio Maglione and Giuseppe Moscatiello, had gone into hiding but were arrested two days later in a home in Arienzo.
According to the prosecution, the murder occurred at the height of a passionate argument. Maglione and Zeppetelli had known each other for some time and apparently had had arguments in the past.
Some grey areas still remain in the case, such as the role of a third man who may have participated in the murder. In addition, Moscatiello's defense has raised doubts about the real dynamics of the facts.
The Appeal trial is nearing its conclusion. The next hearings will be crucial to define the fate of the defendants. There is great anticipation to know the final sentence that will establish the responsibility of Maglione and Moscatiello in the murder of Nicola Zeppetelli.
