The Court of Naples acquits the company of the charges of tax fraud of 5 million euros: economic activities considered legitimate. The Court therefore confirmed the legitimacy of the operations of the company defended by Studio Maior, rejecting the charges of tax fraud for millions of euros.
“At the end of a long and complex process, the Court of Naples acquitted our client, declaring him not guilty of the charges of issuing invoices for non-existent transactions and omitted VAT declarations for a total amount exceeding 5 million euros.
The defense, conducted by Studio Associato Maior and represented by lawyers Pierlorenzo Catalano, Michele Francesco Sorrentino and Filippo Castaldo, demonstrated in court the concrete operation of the company and the actual validity of the disputed operations. Despite its small size and some tax irregularities, it was proven that the company was active and able to justify the declared volumes.
The accusation, based on the alleged fictitious nature of the invoices, was based on elements deemed insufficient by the Court, which accepted our defense line. Furthermore, our team obtained a reduction of the penalty for the omitted declarations, demonstrating that a tax violation does not automatically imply criminal liability.
The Court therefore accepted the request for a reduction in the sentence, recognizing the legitimacy of the company's operations and sanctioning the entrepreneur with a reduced sentence for the omitted declarations.
