Avellino. The Court of Cassation confirmed the sentence of 18 years of imprisonment for Elena Joy, established on appeal. The conviction of Giovanni Limata, Elena's ex-boyfriend, who had been granted partial mental vice: his case will be re-examined in a new second-degree trial.

After the appeal presented by the lawyers Rolando Iorio and Livia Rossi, the decision of the First Criminal Section of the Court of Cassation was awaited with great interest. The Attorney General had requested the rejection of Elena Gioia's appeal, while for Limata he had proposed the partial acceptance of a second ground of appeal presented by the lawyer Iorio, limited to the sanctioning treatment.
The Court of Cassation rejected Elena Gioia's appeal in its entirety, confirming the sentence and obliging her to pay the legal costs. For Giovanni Limata, however, the appeal regarding the redetermination of the sentence was accepted: the sentence was annulled only with regard to the sanctioning treatment, with referral to a different section of the Court of Assizes of Appeal of Napoli for reassessment. Limata's sentence is expected to be further reduced.

On appeal, last April 15, the IV Section of the Assize Court of Naples, presided over by judge Ginevra Abbamondi, had already reduced the sentence to Filed from 24 to 18 years, recognizing a partial mental defect that prevailed over the aggravating circumstances. Elena Gioia had also obtained a reduction in her sentence due to the prevalence of the mitigating circumstances, but without the recognition of a mental defect.
In the first instance, on May 24, 2023, the Court of Assizes of Avellino had sentenced both defendants to 24 years in prison, holding them responsible for the planned murder of Aldo Gioia, committed in collaboration.

The latest news on Elena and Giovanni are interesting but a bit confusing, I don't understand why Limata's sentence was reduced. They should be clear about these trials.
I too have difficulty following the story, there is too much information and every time something changes.
