This morning in Battipaglia, in the Salerno area, the Carabinieri and the Financial Police executed a decree of precautionary seizure in case of emergency, issued by the Salerno Public Prosecutor's Office, of three buildings that, according to what has emerged from the investigations so far, were built on the basis of permits deemed illegitimate.
The recipients of the precautionary measure are 2 officials of the Municipality of Battipaglia, 4 private professionals, 4 legal representatives of the companies carrying out the works and 3 clients, investigated, in various capacities and in competition, for crimes provided for by the Consolidated Law on Construction and ideological falsehood.
According to investigators, officials in charge of the Technical Office of the Municipality of Battipaglia have issued illegitimate building permits for the construction of the 3 buildings, one of 8 floors and the other two of 7, intended for residential use. Those three permits are attributable to construction interventions of 'demolition of pre-existing structures and reconstruction of new buildings, with application of the maximum expansion of 35% of the existing residential volume;
volumetric expansion foreseen as an opportunity by the Campania regional law 19 of 2009 and by the regional law 13 of 20220, for 'extraordinary demolition and reconstruction interventions' or for 'urban regeneration'.
At the basis of the critical issues that would have emerged in relation to each building permit at the centre of the investigation, the correct volumetric determination of the consistencies to be demolished on which the bonus was calculated.
The issuing of building permits deemed illegitimate, in fact, had the consequence that, following the demolition of what were single-family buildings of one or two floors, buildings of seven or eight floors were built, even of a height of more than 20 meters, often without even a precise indication of the housing units that would be located there.
This last indication is essential for calculating the urban planning standards. "All this - the Prosecutor's Office notes - with a significant increase in the urban planning burden".

It is incredible how there were irregularities in the construction of these buildings. The authorities should do more checks on these building permits. It is important that the law is respected to avoid similar situations.
