According to the prosecution, in order to obtain a favorable opinion on the division of the Encal-Inpal patronage into Encal-Cisal and Inpal, Francesco Cavallaro, general secretary of Cisal, allegedly asked Iervolino, at the time the patron of the Pegaso telematic university, to hire the son of Concetta Ferrari, general secretary of the Ministry of Labor.
Iervolino's lawyer, Giuseppe Saccone, also expressed doubts about the judge's decision. “I cannot hide my surprise at a decision for which, at present, the reasons are not known and which, therefore, can only be commented upon when the decisions are filed. – declared Saccone – However, I am certain that this will be a 'creative' motivation, as it must be in order to overcome what clearly emerged in the trial: Dr. Iervolino is completely extraneous to the dynamics of the facts being investigated and has never knowingly played a role in the alleged corruption affair. I am confident that in the subsequent levels of jurisdiction, Dr. Iervolino's reasons will prevail".
