The Court of Cassation declared inadmissible and rejected the appeal presented by Roberto Polito, 46 years old, resident in Capua, thus confirming the sentence to a pecuniary penalty imposed by the Court of Santa Maria Capua Vetere. The sentence, after three levels of judgment, is now final.
The person who reported Polito was a psychologist, Dr. IV, a neighbor of the defendant's sister, who lives in the same condominium park in Capua. The professional had filed a detailed and well-documented complaint against him, accusing him of having threatened her with insulting phrases for trivial reasons and of having pushed her violently, to the point of causing her personal injuries that required hospitalization.
The initial investigations were conducted by the Carabinieri of Capua, and were then entrusted to the judicial police of the Prosecutor's Office to complete the checks. In the criminal trial, Dr. IV, assisted by the lawyers Raffaele and Gaetano Crisileo, joined the civil action. The same lawyers obtained in all levels of judgment, up to the Supreme Court, both the confirmation of Polito's criminal conviction and the recognition of the right to compensation for damages in civil proceedings.
