. The compensation was awarded to a former employee from Scafati (Salerno) in relation to parameters above average compared to other similar cases. According to the lawyer Domenico Carotenuto, who assisted the worker in the compensation request, the sentence sends a clear message on the fundamental role of Justice in protecting the rights and health of workers, especially in industrial contexts.
The sick worker turned to the lawyer Carotenuto for legal advice regarding the legal implications of his illness contracted on duty. In addition, the support of the workers' health association and the medical-legal relations of Dr. Nicola Maria Giorgio played a significant role in the case.
The employee's illness was proven to be solely attributable to exposure to asbestos.
The main arguments considered in the compensation search for this case were the employer's failure to inform about the danger of the presence of asbestos, the lack of procedures to avoid exposure and direct contact with asbestos, and the lack of valid personal protective equipment (PPE) to counteract the inhalation of asbestos fibers.
The worker obtained compensation that also included compensation for his wife and daughters, for a total of 190 thousand euros (130 thousand for the worker, 20 thousand for his wife and each of his daughters) as certified by INAIL. The Civil Court of Torre Annunziata established a significant compensation that opens new perspectives in the protection of workers and their families in cases of exposure to asbestos.
