The first criminal section of the Court of Appeal of Naples, presided over by Dr. Giovanni Carbone, acquitted Franco Antonio Criscione, a geologist from Vitulazio, defended by lawyers Raffaele and Gaetano Crisileo, sentenced in the first instance by the Court of Santa Maria Capua Vetere to 4 years and 2 months in prison.
The Attorney General of the hearing had requested confirmation of the sentence. Competition in bid rigging and competition in aggravated corruption for a specific tender for public works and for geological tests to be carried out in the municipality of Vitulazio in the year 2016; this is the charge with which the defendant and his lawyers faced. In the trial, the civil party was represented by the lawyer Antonio Grillo, who appeared in court on behalf of the Municipality of Vitulazio and who concluded by associating himself with the request for conviction of the Public Prosecutor.

The first-instance panel had forwarded to the Prosecutor's Office the minutes of the hearing in which the then head of the technical office of the Municipality of Vitulazio, Lidia Callone, had been heard, whose position was subsequently archived after being investigated. For the record, at the beginning of 2016 the geologist Criscione was arrested following a precautionary custody order and spent 15 days in prison when he was released by the Court of Review of Naples which accepted the request of his lawyers.
