The Court of Naples has ordered the State to pay 723.000 euros to the heirs of a man from Avellino who died in 2019 from hepatocarcinoma contracted in 1967, following a transfusion of infected blood at the Cardarelli hospital.
The victim, who underwent heart surgery, was infected with hepatitis C. In 2020, the family, assisted by the lawyer Maurizio Albachiara and the association “Tribunale per il diritto del malato” of Acerra, filed a lawsuit against the Ministry of Health.
After a long trial, the VI civil section of the Court recognized the State's responsibility, condemning it to compensate for the damage caused by the loss of the parental relationship.
In 2020, the man's heirs turned to the association "Tribunale per il diritto del malato" of Acerra, which gave a mandate to the lawyer Maurizio Albachiara, to take action against the Ministry of Health for the request for damages suffered during life by their family member and for the damages from the loss of the parental relationship.
The VI Civil Section of the Court of Naples, at the conclusion of a long trial and the related complex investigative activity carried out, has sentenced the ministry to pay the total sum of 723 thousand euros plus interest as damages for loss of parental relationship to be divided between the two children and the granddaughter of the unfortunate pensioner from Avellino.
