Important result for the Municipality of Buccino which puts an end to the matter of the relocation of the Fonderie Pisano in the Industrial Zone of the town.
The Council of State, with sentence number 10045 published today, definitively rules accepting the appeal and rejecting the appeal in the first instance.
In the specifics of the judgment: the resolution of the Municipal Council of Whelk number 60 of 17 May 2018 with which the variation to the PUC was adopted, relating to the Industrial Area, limiting the establishment only to agri-food activities; the resolution of the ASI consortium of Salerno number 168 of 8 June 2018 of suspension for a period of six months of the selection procedure relating to the applications for the assignment of the lots falling within the industrial area of Buccino; the council resolution number 2 of 4 February 2019 of approval of the variation to the PUC
As stated, these provisions were challenged with an appeal and two additional grounds before the TAR for Campania by Fonderie Pisano & C. spa, a company operating in the cast iron production sector which, having participated in the tender issued by the Consortium to acquire a property in the industrial area, proposed numerous grounds against them, including "excess of power (diversion, arbitrariness, lack of presupposition, perplexity), violation of the principles of due process, good practice and impartiality, as well as the constitutional rights of economic initiative and property".
With sentence number 401 of 2 April 2020, the TAR for Campania declared the introductory appeal and the first additional grounds inadmissible and accepted the second additional grounds against the definitive approval of the variant by the Municipal Council of Buccino.
After this ruling by the TAR, the Municipality therefore requested the intervention of the Council of State.
"The matter is definitively closed. Fonderie Pisano will not come to Buccino. This wonderful news, the result of constant, serious and coherent work by our lawyers and technicians, the municipal offices and all the administrators, satisfies us completely. Thanks to the administrators of the neighboring towns, to the many citizens and to the associations that supported us in this matter" commented the mayor Pasquale Freda.
