The Court of Cassation has annulled a sentence issued by the Surveillance Court of Naples concerning the well-known criminal from Benevento, Enzo Formisano
The case involves the 38-year-old, who had his probation with social services revoked. The Surveillance Court had ruled that the three years spent in probation were not counted towards serving the sentence, requiring Formisano to repeat that period in detention again.
Accepting the arguments of Attorney Fucci, the Court of Cassation annulled the sentence of the Surveillance Court. The case of Enzo Formisano will be examined again by a different panel of judges of the Surveillance Court of Naples to celebrate a new trial.
This decision reopens the way for a re-examination of Formisano's legal position and highlights the decisive role of the Supreme Court in verifying the correct application of legal procedures.
