Caivano. 1 million euros of damage to the treasury for uncollected rents and occupation allowances in Green Park.
Sentencing of 6 former officials and administrators of the municipality of CaivanoThe liability proceedings against six former officials and administrators of the Municipality of Caivano, initiated at the request of the Regional Prosecutor's Office, following a report of damages formalized in 2017 by the then Carabinieri Lieutenancy of Caivano, now elevated to Company Command, ended with a conviction issued by the Court of Auditors, Regional Jurisdictional Section for Campania.
The information was descriptive of a type of damage to the treasury connected to the failure to collect rents and occupancy fees for residential properties and commercial premises in the “Parco Verde” real estate complex, built pursuant to Title VIII of Law 219/1981 and transferred to the available assets of the Authority.
The subsequent investigative activity delegated to the Tenenza allowed the filing of further information, deemed by the Court to be indispensable for the purposes of the judgment and describing the failure to collect the aforementioned payments, for the years 2004/2009, for 422 housing units out of 750; as well as, for the years 2009/2013, for 34 commercial premises, with consequent economic-financial imbalance of the Authority.
The investigation also revealed the proven knowledge by the convicted persons of the critical issues related to the ongoing default/illegal occupation of real estate assets and the failure to adopt measures aimed at activating the legal procedures necessary to recover the defaults, omissions preparatory to the Decree of April 2018 of the President of the Republic which ordered the administration to be managed by a commissioner in order to condition the administration to pressing interference from organised crime.
Now the Court of Auditors of Naples has ruled calculating a financial damage of 1.000.000 euros that the convicted will be called to pay in favour of the Municipality of Caivano, which in these days is the subject of a new decree of dissolution of the Municipal Council, ex art. 141 TUEL, by the Prefect of Napoli.
