The investigation focuses on an alleged ideological forgery relating to the “Declaration relating to the composition and structure of Dicembre società semplice” dated June 30, 2021. This document was filed with the Companies Registry Office. Dicembre is known for being the vehicle through which the Agnelli family, through John Elkann, maintains control over various assets of the group, including the Exor holding company.
According to initial information gathered, the search led to the seizure of documents related to the Dicembre company, the family's historic safe. This company managed a series of operations between 2004 and 2019, which redefined its current composition, with the brothers John Elkann, Lapo Elkann and Ginevra Elkann as main partners.
Examination of property deeds
Investigators are examining the documentation regarding the transfer, in May 2004, of the bare ownership of approximately 40% of the shares by Marella Caracciolo, retaining the usufruct for herself. The investigations aim to clarify whether these deeds were altered or falsified, and whether fraud crimes were committed against the State in relation to the payment of inheritance taxes following Marella's death in 2019. This analysis is underway to determine the correctness of the tax practices adopted in that context.
