LThe Court of Cassation, with ruling number 45402 of 2024 of the fourth criminal section, confirmed the sentence of 1 year and two months of imprisonment and two years of suspension of the driving license, of a 51-year-old worker from Naples for a road accident that caused the death of a colleague and the injury of 4 others.
He was driving a van on his way home from work. He was accused, in addition to being tired at the wheel after a night shift, of not having made sure the passengers were wearing seat belts.
The team had left from Lodi to return to Campania, place of residence of the workers, and was in charge of track maintenance. The accident occurred on the A1 in Scandicci: Michele Crisci, 54 years old from Maddaloni, was thrown from the cockpit and died instantly.
The Court of Cassation, in sentencing the man for road homicide, concluding that the victims were not wearing their seat belts, noted among other things that "the driver of a vehicle is required to demand that the passenger wears the seat belt and, in the event of his refusal, also to refuse to transport him or to fail to start the journey".




It is really sad that such an accident happened. Driver responsibility is very important for everyone's safety. I hope this case can serve as a lesson to many other drivers.
I read about the accident and the conviction, it is very sad that there were deaths and injuries. But I wonder if the worker was really fit to drive after a night shift. Maybe there are more factors to consider.
