Naples – They are void due to lack of inspection and lack of insurance coverage if carried out with non-approved cameras, and the Authority is also sentenced to pay the legal costs.
This is what lawyer Cristiano Ceriello, legal representative of the consumer association “Difesa Consumatori e Contribuenti”, reports, after one of the latest sentences obtained by the association and recently published by the Justice of the Peace of Nola, in the province of Naples and published a few days ago.
As explained by the lawyer Ceriello, the fines are increasing especially for contested failure to have a vehicle inspected using cameras and not contested at the moment.
However, even for the lack of inspection or proof of insurance coverage, it can be ascertained automatically with the use of electronic equipment and with the possibility of deferred contestation, but only with the use of a device approved by the Ministry of Infrastructure and Transport. In the absence of this, the fine is null and void.
The same interpretative line was also confirmed by the Ministry of the Interior with a not very widespread circular, number 300/A/4684/20/127/9 of 3 July 2020, with which it was specified that the detection of the violation provided for by article 193 for the lack of insurance coverage and the violation provided for by article 80, c.14, for a vehicle with expired inspection, reported by the electronic device, if carried out with non-approved electronic devices and without periodic checks, is null and void.
This is the main reason for the Nolan ruling which, in the case in question, also condemned the Authority to, expenses that citizens will indirectly pay anyway, since it is a Public Authority that issued a fine affected by nullity which however, as Dr. Pasquale Di Carluccio (president of the consumers' association) points out, must be contested in time, within 30 or 60 days, under penalty of confirmation of a null report and damage to our pockets.

Very interesting this article, but I don't understand how these rules are applied, it seems complicated for us citizens. Let's hope there is more clarity to avoid unfair fines and confusion in the future.
