Battipaglia – The Carabinieri of the Investigative Unit of the Provincial Command of Salerno, in collaboration with the financial police of the Company of Battipaglia, seized two properties in the municipality of Battipaglia. The buildings were allegedly constructed on the basis of building permits deemed illegitimate.
The preventive seizure order, issued by the Public Prosecutor's Office of Salerno, involves two officials of the Technical Office of the Municipality of Battipaglia, two private professionals, the legal representative of the company carrying out the work and five clients. The suspects are accused, in various capacities and in competition, of crimes provided for by the Consolidated Law on Construction and of ideological falsehood.
According to the investigation, municipal officials allegedly issued unauthorized building permits for the construction of two residential buildings: one with seven floors and the other with three. The permits concerned demolition of pre-existing structures and reconstruction of new buildings, with a maximum volumetric expansion of 35% compared to the existing residential volume.
Such expansion would have been permitted, in the first case, under a regional law of Campania and, in the second, under the so-called Recovery Plan.
The main critical issues that emerged concern the correct determination of the volume of the buildings to be demolished, on which the bonus was calculated, the erroneous classification of the demolition intervention as "extraordinary maintenance" and the application of the Recovery Plan despite it having expired for over ten years.
Following the issuance of these building permits deemed illegitimate, pre-existing two-story buildings were demolished and three- and seven-story buildings, with a height exceeding 20 meters, were built, causing a significant increase in the urban planning burden.
