Naples – There are no discounts, at least for now, for the four young people accused of involvement in the shooting that erupted on December 12th in Piazza Carolina, in the heart of Chiaia, just a few dozen meters from Piazza del Plebiscito. It was a night when violence between groups of teenagers spilled over into one of the most popular and frequented spots in downtown Naples, transforming the square into a Wild West scene for a few interminable minutes.

Months later, the case reached a crucial stage in the proceedings. Before the Juvenile Court, the four defendants were heard by Judge Anita Polito and Public Prosecutor Ugo Miraglia. But their statements were not enough to convince the judge to grant them an alternative route to trial.

As reported by Il Roma, the defense team's requests for probation were rejected. Therefore, for the four young men, there will not be, at least at this stage, an early rehabilitation program designed to conclude the proceedings through a recovery program. The case will proceed with the abbreviated procedure, with the next hearing scheduled for the end of October.

The night of the gunfire between Chiaia and Piazza Plebiscito

The shooting in Piazza Carolina had brought to light a conflict between very young people that, according to the investigative reconstruction, could be traced back to two groups from different but geographically close areas: on one side the Spanish Quarters, on the other the Pallonetto di Santa Lucia.

According to the proceedings, the conflict originated from an argument that escalated on social media and quickly escalated. This fact clearly illustrates the seemingly trivial nature of the situation, which can lead to much more serious forms of violence, especially when the confrontation involves very young people who transform a provocation, an insult, or a virtual challenge into a real-world settling of scores.

That evening, however, the scale of the argument gave way to weapons. The gunfire in a central, crowded area of ​​the city marked the breaking point of an escalation that investigators later reconstructed through witness statements, investigations, and investigative efforts.

The incident had raised particular alarm due to the age of the participants and the location chosen for the clash: not an isolated suburb, but the monumental and touristic heart of Naples, a stone's throw from Piazza del Plebiscito.

The arrests and the investigators' reconstruction

The investigation had identified the youths believed to be involved in the shooting and delineated the two sides of the conflict. Among those at the center of the investigation was Vincenzo Giovanni Percich, an adult, listed as a co-suspect and believed to be linked to the two minors from the Spanish Quarters.

For the four boys, the juvenile proceedings have therefore taken different forms depending on their respective positions. Not all of them face the same charges, and in particular, the young man from Pallonetto is charged with weapons and not attempted murder.

It is precisely on this accusatory framework, on the individual responsibilities and on the role that each one allegedly had that evening that the decisive phase of the proceedings will now focus.

Different versions and many silences in the classroom

During the hearing, the four young men were examined by the judge and the prosecutor. And it was precisely the content of their statements that influenced the decision regarding probation.

The two minors from the Spanish Quarters, represented by lawyers Domenico Dello Iacono and Leopoldo Perone, admitted their responsibility, but traced the origin of the fight to an argument that arose on social media.

An explanation that, however, would not have fully clarified the motive and, above all, the path that would have transformed that argument into a shooting.

On the other hand, the young man from Pallonetto, represented by lawyer Giuseppe De Gregorio, denied the charges and denied passing the gun to his companion. His position in the case, as mentioned, is limited to the weapons charges and does not include attempted murder.

Even more incomplete was the reconstruction provided by the fourth defendant, represented by attorney Tiziana De Masi. An overall picture characterized, according to what emerged at the hearing, by partial admissions, denials, and, above all, numerous points left without a convincing explanation.

The knot of awareness

This is precisely one of the most significant aspects of the Juvenile Court's decision. Probation, in juvenile proceedings, is not simply a shortcut to trial, but a tool aimed at the minor's recovery through a process of empowerment and social reintegration.

In the case of the four defendants, the judge did not, at this time, find sufficient conditions to grant this benefit. Also weighing heavily were the manner of the statements made during the hearing and what was interpreted as an insufficient appreciation of the seriousness of the alleged conduct.

This is a delicate point, because behind the procedural formula there is a broader question that concerns the entire phenomenon of so-called baby gangs: how much awareness has actually matured among young people when violence is considered a possible response to an insult, a provocation or a rivalry?

In the case of Piazza Carolina, the answer won't come solely from the sentences. It will also have to come from the protagonists' ability to understand that a gun pulled during a fight between teenagers can, in a matter of seconds, transform a prank, a settling of scores, or a rivalry between groups into an irreversible tragedy.

The closing speech and the sentence will be in October

The rejection of the probation requests now opens the decisive phase of the proceedings. At the end of October, before the Juvenile Court, Public Prosecutor Ugo Miraglia's closing statement is scheduled, along with the prosecution's requests, followed by the defense's oral arguments, and finally the sentencing.

That will be the moment when the judge will have to evaluate the material gathered during the investigation, the defendants' statements, and the reconstruction of the incident, distinguishing the individual positions and establishing any criminal liability.

The Piazza Carolina legal case thus reaches a crossroads. For the four young men, the path to recovery, if it comes to fruition, could also involve serving their sentences. But first, the trial will have to establish what really happened that night and what role each of them played.

In the background, the most disturbing image of the entire story remains: four very young people, two opposing groups, and a fight that erupted on social media and spilled over into real life, culminating in gunshots in the heart of Naples. A story that, beyond the individual responsibilities that will have to be determined in court, once again demonstrates the fine line between violence displayed as language between teenagers and the very real risk that that same violence will result in victims.
